Developer Denied Contested Subdividing of 889 Royal York Road

Background

In March 2019, the Committee of Adjustment refused the proposed development application at 889 Royal York Road B0037/18EYK. The applicant appealed the Committee of Adjustment’s refusal to the Toronto Local Appeal Body (TLAB).

At City Council Councillor Grimes requested that the City Solicitor and any appropriate City Staff attend the TLAB hearing to uphold the Committee’s refusal of the application. This application is not fitting with the character of the neighbourhood, and he’s committed to ensuring that our community receives the best possible outcome with this file.

The applicant requested consent to sever the property into two undersized lots. The proposal would result in two separate properties, each with a frontage of only 7.62m wide with a lot area of 263.7m2.

Community Planning staff do not support this application, and City planning staff submitted a report in February 2019 to the Committee of Adjustment to recommend refusal. Planning recommended refusal on the grounds that the applications for two undersized lots is not in keeping with the established character and lot pattern of the neighbourhood.

Councillor Grimes motion also authorizes the City Solicitor to attempt to negotiate a resolution of the appeal. If a resolution is reached, the City Solicitor can settle the appeal, in consultation with his office, and the Chief Planner and Executive Director of City Planning.
